Consumer Health Data Privacy Notice

Washington My Health My Data Act Notice

This notice is intentionally separate from Tidewell's general Privacy Policy, as required by the Washington My Health My Data Act.

1. What This Notice Covers

This notice describes how Digital Whims LLC ("Tidewell," "we," "us") collects, uses, and shares "Consumer Health Data" as defined by the Washington My Health My Data Act ("MHMDA"), and explains the rights MHMDA gives you regarding that data. This notice applies to all users of Tidewell whose data is subject to MHMDA, regardless of where you live, consistent with the Act's broad application to anyone whose consumer health data is collected while in Washington or who is a Washington consumer.

This notice supplements, and does not replace, our general Privacy Policy, which describes our broader data practices.

2. Categories of Consumer Health Data We Collect

"Consumer health data" under MHMDA means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer's past, present, or future physical or mental health status. In the ordinary operation of the Service, this includes:

3. How We Collect Consumer Health Data

We collect consumer health data directly from you — specifically, whatever you choose to enter into the Service (cycle dates, symptoms, mood, medications, and similar entries). We do not purchase consumer health data from data brokers or other third parties, and we do not derive it by inference from unrelated data sources.

We collect and use consumer health data solely to:

We do not use consumer health data for advertising, do not use it to train third-party AI or machine-learning models, and do not use it for any purpose other than providing the Service to you and the purposes listed above.

5. How We Share Consumer Health Data

We do not sell consumer health data, as "sale" is defined under MHMDA. We share consumer health data only with the following categories of service providers, each engaged solely to help us operate the Service and each bound by confidentiality and security obligations:

We do not share consumer health data with data brokers, advertisers, or any other third party for their own independent use. We do not share consumer health data with affiliates for purposes unrelated to operating the Service.

6. No Geofencing

Consistent with MHMDA's prohibition on using geofencing around health care facilities to identify, track, collect data from, or send messages to consumers seeking health care services, Tidewell does not use geofencing technology for any purpose.

7. Your Rights Under MHMDA

You have the right to:

We do not discriminate against you for exercising any of these rights.

7.1 How to Withdraw Consent

You may withdraw consent to further collection or sharing of your consumer health data at any time by contacting us at [email protected], or, where the setting is available, by adjusting it directly in Settings. Once you withdraw consent, we will stop collecting or sharing your consumer health data going forward, within the timeframe required by MHMDA, and will cease sharing consumer health data collected before your withdrawal unless retention is otherwise legally required. Note that withdrawing consent may limit or disable Service functionality that depends on that data.

One specific way to withdraw consent: switching your account from cloud storage to local-only storage in Settings presents you with a choice. If you choose "Delete cloud copy," your consumer health data is deleted from our cloud servers as part of that switch, and from that point on your data exists only on your own device. If you instead choose "Keep cloud copy as a backup," your existing cloud data is retained as a frozen snapshot that no longer receives new entries, until you separately request its deletion. If you later switch back to cloud storage, you will be asked to give your consent again before any data is stored on our servers going forward.

7.2 How to Request Deletion

You may request deletion of your consumer health data directly within Settings (Delete Account), or by contacting us at [email protected]. Upon a verified deletion request, we will delete your consumer health data from our records and instruct any applicable service providers to do the same, except where retention is required by law.

As described in Section 7.1, you can also delete your cloud-stored consumer health data specifically by switching to local-only storage in Settings and choosing "Delete cloud copy," without deleting your account entirely.

7.3 How to Submit a Request

Submit any request under this notice to [email protected]. We will respond within the time required by MHMDA. Because account deletion removes your consumer health data from our records entirely, a deletion request under Section 7.2 leaves nothing for a subsequent appeal to act on — there is no separate appeal process for deletion requests specifically.

8. Changes to This Notice

If we materially change the categories of consumer health data we collect, the purposes for which we use it, or the third parties with whom we share it, we will update this notice and, where required, obtain renewed consent before the change takes effect.
